Tracy Morgan has just been released from a rehabilitation facility. He is currently recovering from some serious injuries that he obtained after suffering in a fatal car crash that killed one of his friends, who happens to be a fellow comedian. According to his spokesperson, Lewis Kay, Tracy Morgan will resume his recovery at his own home with an "aggressive outpatient program."
The former star of "30 Rock" has suffered from a broken leg and broken ribs when the limousine van that he was in was hit from behind by a Wal-Mart truck on the 7th of June on the New Jersey Turnpike. This multiple vehicular accident killed James McNair, a 62-year-old comedian who was more popularly known as Jimmy Mack. Other victims who were with them on that night were co-comedian Ardley Fuqua and another passenger, Jeffrey Millea. They were also seriously injured.
Tracy Morgan's lawyers filed a lawsuit on Thursday against Bentonville, Arkansas-based Wal-Mart Stores, Inc. in the United States District Court in New Jersey. His lawyers claimed that this particular retailer was very negligent when one of their drivers rammed into the limousine van that Tracy Morgan and his friends were riding.
The lawsuit claims that the famous retail giant should have been aware that its driver had been awake for more than 24 hours and that his 700-mile commute, from his personal home in Georgia to work in Delaware, was very "unreasonable." The complaint also includes some allegations that the said driver actually fell asleep while driving.
According to what has been filed by Tracy Morgan's lawyers, "As a result of Wal-Mart's gross, reckless, willful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages." This lawsuit seeks a jury trial and punitive and compensatory damages.
Fuqua, Millea, and Millea's wife, Krista, have also been named as plaintiffs within Tracy Morgan's filed suit. Krista Millea was not a passenger in the limousine van, but is included in the plaintiff since she has a related "loss of services" lawsuit that stems from the crash.
