A Vibram refund proposal is being considered after the shoe company tries to settle a lawsuit against them.
Maker of the glove-like FiveFingers running shoes, Vibram USA, has agreed to settle a lawsuit alleging they made a false and overstated claims about the health benefits of the footwear. The lawsuit, which was filed in the U.S. District Court in Massachusetts says that Vibram charged nearly $100 for a pair of shoes on the basis of its unsubstantiated claims that the kind of footwear strengthens the muscles and prevents injury. With that, a Vibram refund proposed settlement was filed last week and is now waiting for an approval.
It was actually way back in March 2012 that the lawsuit was filed in Massachusetts where the Vibram's headquarters is located. A report says that Valerie Bezdek has filed the complaint against Vibram after it allegedly deceived customers through the company's exaggerated advertisement about its health benefits. However, the company strongly denied the wrongdoing yet offered a Vibram refund to its customers for a settlement.
The shoemaker company offered to pay a total of $3.75 million to all buyers of the FiveFingers. They also even said that they would no longer make health claims in their advertisements. If the Vibram refund settlement will be approved, customers who bought the FiveFingers shoes, even since March 2009 will be eligible for the said settlement.
The Vibram refund could reach up to $94 per pair purchased, according to the court filing. Consumers can submit a claim for up to two pairs of shoes, but a proof of purchase may need to be presented. Moreover, the company is required to create a website relating to the settlement of the lawsuit and to help customers who want to have a reimbursement.
If any of the proposed total amount remains, it will be donated to the American Heart Association for its research on the health benefits brought by running.
